eBay Shipping Terms and Conditions

eBay Marketplaces GmbH (“eBay”) makes shipping services available to you for eligible listings and transactions on eBay (the “Services”). Depending on the applicable shipping option, eBay may make a prepaid shipping label available to you or facilitate your purchase of a shipping label through eBay. If eBay makes a prepaid shipping label available to you, the shipping service is provided to you by eBay and the physical carriage is performed by a third-party carrier. If you purchase a shipping label through eBay, the shipping service may be provided by eBay or by the relevant third party carrier, depending on the shipping option you select. Where the shipping service is provided by a third party carrier, eBay facilitates your purchase as an agent for that carrier. Where eBay makes a prepaid shipping label available, your buyer may be offered delivery options at checkout. By using the Services, or continuing to offer an eligible listing after being notified that the Services will apply to future sales through that listing, you acknowledge and agree that these eBay shipping Terms and Conditions (“Terms”) apply to your use of the Services in connection with any items purchased from you for delivery through the Services.
1. Applicability of eBay User Agreement. The eBay.com.au User Agreement, Payments Terms of Use, eBay balance Terms and Conditions, User Privacy Notice and all policies posted on eBay.com.au (together, “eBay Policies”) apply in addition to these Terms. If there is any conflict or inconsistency, these Terms will control in relation to matters concerning the Services that they expressly address. The Payments Terms of Use, and where applicable, eBay balance Terms and Conditions (together, “Payment Terms”) which are provided by eBay Commerce Australia Pty Ltd (the “Payment entity”), will continue to govern payment processing and the collection of amounts you owe.
2. Applicability of third party carrier terms. The relevant carrier terms are set out in the Annex to these Terms or otherwise made available to you through the relevant shipping flow (“Carrier Terms”). Where you purchase a shipping label through eBay and the shipping service is provided by the relevant carrier, the applicable Carrier Terms govern the shipping service. Where the shipping service is provided by eBay, these Terms govern the shipping service, subject to any applicable carrier requirements relating to the physical carriage of your parcel. Subject to clause 1, in the event of any conflict or inconsistency between these Terms and the Carrier Terms, these Terms will control in relation to matters they expressly address.
3. Description of the Services. The Services are made available by eBay Marketplaces GmbH (“eBay”) through third party carrier networks. By agreeing to these Terms, you will be entering into an agreement with eBay for the provision of the Services. Depending on the relevant listing or transaction, eBay may determine the applicable carrier or shipping service and provide you with a prepaid shipping label, or may make carrier and shipping service options available for you to choose and buy a shipping label through eBay. Where eBay provides you with a prepaid label, the shipping service may be provided by eBay or by the applicable carrier, depending on the shipping option selected. Where the applicable carrier provides the shipping service, eBay facilitates your purchase as an agent for that carrier. In each case, the applicable carrier performs the physical carriage and delivery of the parcel. You acknowledge and agree that eBay may use third party carriers and other subcontractors under contract with eBay to assist it in performing the Services.
4. eBay shipping fees.
a. Fees. Where eBay provides you with a prepaid label, eBay may determine the applicable shipping charge shown to your buyer. If you choose to offer the buyer free shipping, you agree to pay the shipping fee presented to you within the listing flow. Where you choose and purchase a label through eBay, you agree to pay the label price presented at the time of purchase. The amount, if any, that you charge your buyer for shipping may be free, a flat amount or an eBay calculated amount, where those options are available, and may differ from the price you pay for the label.
b. Tax. Unless otherwise stated, all fees and charges payable by you under these Terms are inclusive of GST.
c. Supply of Services. Where eBay provides you with a prepaid label, the shipping service is supplied to you by eBay Marketplaces GmbH, regardless of whether the applicable shipping cost is paid by you or your buyer. Where you choose and buy a shipping label on eBay, the shipping service may be supplied to you by eBay Marketplaces GmbH or by the applicable carrier, depending on the shipping option selected. Where the service is supplied by the carrier, eBay facilitates the purchase as an agent for that carrier. You remain responsible for complying with these Terms and any applicable Carrier Terms or carrier requirements in connection with the shipment.
d. Accurate parcel details and additional charges. You must provide accurate information about your parcel, including its weight, dimensions, packaging and contents. If eBay or the applicable carrier determines that the information you provided was inaccurate, that the parcel was under declared or that the label was not appropriate for the parcel, eBay may charge you the applicable difference where eBay provides the shipping service, or may collect any applicable adjustment imposed by the carrier where you purchase a shipping label through eBay. We will provide you with reasonable details of any such adjustment. You authorise eBay and the Payment entity to collect the relevant amount in accordance with the Payments Terms.
e. Rates. Where eBay provides you with a prepaid label, eBay sets the prices and fees. Where you purchase a shipping label through eBay, the price presented to you may be determined by eBay or the applicable carrier, depending on the shipping option. These may vary due to factors including the weight, dimensions, value or category of the item, the available carrier or shipping service, and other relevant service characteristics. Except for an adjustment under clause 4(d), the applicable price for a label will not change after the label has been purchased or provided for a completed transaction.
f. Collection of amounts owed. You authorise eBay and the Payment entity to collect any amount you owe in connection with the Services, or any amount that eBay is authorised to collect on behalf of a carrier, in accordance with the Payments Terms. This may include deducting the amount from current or future payouts or charging a linked financial account or another payment method you have authorised for use by the Payment entity.
5. Eligibility and application of the Services.
a. Eligibility. Not all sellers, listings or transactions are eligible for the Services. Eligibility may depend on factors such as your account status, the item category or value, parcel weight or dimensions, item location and the availability of the relevant carrier or shipping service. eBay will indicate through the relevant listing, account or transaction flow when the Services are available or required.
b. Required use. Where eBay provides a prepaid label for an eligible listing or transaction, or otherwise notifies you that an eBay provided label or QR code is required for domestic delivery of the relevant item, you must use that label or QR code unless the Services are unavailable for that transaction or eBay expressly permits another option. Where shipping labels are available for you to choose and purchase through eBay and eBay has not notified you that use of an eBay provided label is required, you may choose another shipping method, subject to the applicable eBay Policies and any shipping requirements communicated to you.
c. Existing listings. eBay may require prepaid shipping labels to be used for eligible existing listings for sales occurring on or after the date specified in a notice to you. We will give you reasonable advance notice of a material change and explain how it will affect your listings. Before the change takes effect, you may end or revise an affected listing where permitted. If you continue to offer the listing after the effective date, the requirement to use the prepaid shipping label will apply to future sales made through that listing.
d. eBay Pro plans. eBay Pro plans may provide additional domestic shipping options. eBay Pro plans are subject to separate terms, fees, features and eligibility requirements. The effect of changing your selling plan on existing and future listings will be shown to you before you subscribe or change plans.
e. Changes to eligibility. eBay may change the eligibility criteria for future listings and sales where reasonably necessary because of service or carrier availability, product functionality, or legal, safety, security, fraud, operational or risk requirements. We will provide reasonable advance notice of any material change that is adverse to you. Where an urgent change is reasonably necessary to comply with law or address a genuine safety, security or fraud risk, we may make the change without advance notice but will notify you as soon as reasonably practicable. A change will not affect a sale completed before the change takes effect.
f. Domestic delivery only. The Services under these Terms apply only to domestic delivery within Australia. Any international shipping service you select is separate from the Services and may be subject to additional terms and conditions.
6. Data Protection. eBay will process personal information in connection with the Services in accordance with the eBay User Privacy Notice. To provide the Services, eBay may share relevant personal and order information with third party carriers selected by you or determined by eBay to provide or support the relevant Services. You are responsible for ensuring that the information you provide to eBay is accurate and up to date. Third party carriers may use personal information in accordance with their applicable privacy notices and legal obligations.
7. Prohibited and Restricted Items. You must not use the Services for any item that may not lawfully be listed or sold on eBay, that does not comply with eBay’s Prohibited and restricted items policy, or that is prohibited under the applicable Carrier Terms or carrier requirements. Restricted items may only be sent if all applicable conditions are met. An item may be permitted to be listed or sold on eBay but still be ineligible for the Services. Any additional exclusions or conditions that apply specifically to the Services will be shown to you in the relevant listing or shipping flow. Third party carriers may refuse to accept, inspect, hold, return or otherwise deal with a parcel where permitted or required under applicable law or their applicable terms and conditions. If your item or parcel does not comply with all applicable carrier packaging, labelling and lodgement requirements, the Services may be unavailable, or your parcel may be delayed, rejected or returned. Your eligibility for Seller Protection may also be affected where your non compliance caused or contributed to the relevant loss, damage or delivery issue.
8. Seller Responsibilities. Once eBay notifies you that your item has sold and is ready to be shipped, you must package it securely and in accordance with the applicable carrier packaging, labelling and lodgement requirements and any service specific packaging requirements presented to you. You must ensure that all information you provide about the parcel, including its contents, weight and dimensions, is complete and accurate and that the parcel meets the limits applicable to the label or QR code provided to you or selected by you. You must lodge the parcel with the applicable carrier within your stated handling time, using the drop off, collection or lodgement option made available to you, and follow any reasonable instructions provided by eBay or the carrier that are necessary to complete delivery. If you print the label yourself, you must ensure that it is clearly visible and securely attached to the parcel. The label or QR code may only be used for the relevant eBay transaction and only once, and must not be used after it has been cancelled, voided or refunded. If you do not comply with these requirements, your parcel may be delayed, rejected or returned, and additional charges may apply. Your eligibility for any applicable Seller Protection or carrier compensation may also be reduced or unavailable, but only to the extent that your non compliance caused or materially contributed to the relevant loss, damage or delivery issue.
9. Returns. Items purchased using the Services remain subject to the eBay Money Back Guarantee policy, your returns policy and any other applicable eBay Policies. If your buyer is entitled to a return or refund, you may be required to refund the item price and/or the original delivery charges in accordance with those policies. Any return shipping service made available by eBay is separate from the Services and may be subject to separate terms and conditions.
10. Undeliverable or Uncollected Items. If the carrier is unable to deliver your parcel, or if your buyer does not collect it within the applicable collection period, the parcel may be redirected to another collection point, returned to you or otherwise dealt with in accordance with the applicable Carrier Terms or carrier requirements. If an item is returned to you, any refund due to the buyer will be handled in accordance with the applicable eBay Policies. If the delivery issue was caused or materially contributed to by your failure to comply with these Terms or the Carrier Terms or carrier requirements, additional charges may apply and your eligibility for any applicable Seller Protection or carrier compensation may be affected.
11. Compliance with Applicable Laws. You must comply with all applicable laws and regulations in connection with your use of the Services, including any requirements relating to the contents, packaging, labelling, transport and lodgement of your parcel.
12. Protection for Loss or Damage. You remain responsible for any loss or damage to your item until it has been accepted and scanned into the applicable carrier network. Once your item has been scanned into the carrier network, it may be eligible for Seller Protection for loss or damage occurring during transit, depending on the applicable shipping option and subject to these Terms and the applicable eBay Policies. The applicable eligibility requirements, protection limits, exclusions and claims process are set out in our Seller protections policy. Where additional cover is made available when you purchase a label through eBay, that additional cover is provided by the applicable carrier and is subject to the applicable carrier terms presented to you at the time of purchase. eBay facilitates the purchase of the additional cover and collects the applicable amount as agent for the carrier. The applicable eligibility requirements, exclusions and claims process are set out on our seller protections page. Seller Protection may be reduced or unavailable where eBay reasonably determines that you have acted fraudulently, or to the extent that the relevant loss or damage was caused or materially contributed to by your failure to comply with these Terms, the eBay Policies or the Carrier Terms.
13. Transfer of title. At no time does eBay or the carrier take title to, or acquire any ownership interest in, the item by reason of providing the Services. Title to the item passes between you and your buyer in accordance with the terms applicable to the sale and applicable law.
14. Transaction Adjustments and Cancellations. If, after an item has sold, eBay determines that the Services cannot be provided for that transaction, eBay may take reasonable steps to cancel or adjust the transaction and refund the buyer where necessary, in accordance with the eBay User Agreement, Payments Terms and other applicable eBay Policies. eBay may also take action under those terms where it reasonably believes that there has been fraud or misuse of the Services.
15. Refunds for Unused Labels. Where you choose and purchase a label through eBay, you may request cancellation or a refund of an unused label through the process made available by eBay, where the applicable carrier and service permit this. eBay facilitates the refund request as agent for the carrier, and eligibility for a refund is determined under the applicable Carrier Terms. A refund may be available where the carrier confirms that the label has not been used or scanned in its network and the applicable refund requirements are otherwise met. eBay may decline or withhold a refund on the carrier’s behalf where the applicable refund requirements are not met. Any approved refund will be processed through the applicable eBay payment methods. Where eBay provides you with a prepaid label, you cannot cancel or void that label yourself. If the prepaid label cannot be used or the relevant transaction is cancelled or adjusted, it will be handled in accordance with the process made available by eBay and the applicable eBay Policies.
16. Statutory Rights and Warranties. Except as expressly provided in these Terms, and to the extent permitted by law, eBay excludes all implied warranties, terms and conditions in relation to the Services provided or facilitated by eBay. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, restricted or modified. To the extent permitted by law, eBay's liability for breach of any non excludable statutory guarantee applicable to a service provided by eBay is limited to the resupply of the Services or the payment of the cost of having the Services supplied again. Where the shipping service is provided directly by a carrier, nothing in this clause excludes, restricts or modifies any rights or remedies you may have against that carrier under the Carrier Terms or applicable law.
17. Limitation of Liability. Except for any refund or eBay Seller Protection amount expressly payable under these Terms, and to the extent permitted by law, eBay will not be liable for any loss of money, goodwill or reputation, or any special, indirect or consequential loss or damage arising directly or indirectly out of your use of, or inability to use, the Services. Where the shipping service is provided directly by a carrier, this clause applies only to eBay’s role in making the service available or facilitating the transaction and does not limit or exclude any liability the carrier may have under the Carrier Terms or applicable law. Nothing in this clause limits or excludes any liability that cannot lawfully be limited or excluded.
18. Indemnification. You will indemnify eBay, including its subsidiaries, affiliates, directors, officers, agents and employees, against any third party claim or demand, including reasonable legal fees and costs, arising out of your breach of these Terms, the eBay Policies or the Carrier Terms or carrier requirements, or your infringement of any applicable law or the rights of a third party in connection with your use of the Services.
19. Events Outside Our Control. eBay will not be responsible for any failure or delay in performing its obligations under these Terms to the extent caused by an event beyond its reasonable control, including natural disasters, severe weather, industrial action, war, civil unrest, failure or disruption of telecommunications or transport networks, or the unavailability or interruption of services provided by the carrier or another third party on which the Services depend.
20. No Partnership or Agency. Nothing in these Terms creates any partnership, joint venture, employment, franchise or agency relationship between you and eBay.
21. Third Party Rights. Except as otherwise expressly provided in these Terms, these Terms do not confer any rights or benefits on any third party. Nothing in these Terms limits any rights that carriers may have against you under the Carrier Terms where you purchase a shipping label through eBay, or under any applicable carrier requirements where eBay makes a prepaid shipping label available to you.
22. Entire Agreement. Except as otherwise provided in these Terms, these Terms together with the eBay Policies set out the agreement between you and eBay in relation to the Services provided or facilitated by eBay. Where you purchase a shipping label through eBay, the applicable Carrier Terms separately govern your contract with the carrier for the shipping service.
23. Waiver. eBay’s failure or delay in exercising or enforcing any right or provision under these Terms does not constitute a waiver of that right or provision.
24. Severance. If any provision of these Terms is held to be invalid, illegal or unenforceable, that provision will be severed to the extent necessary and the remaining provisions will continue in full force and effect.
25. Changes to or Discontinuation of the Services. eBay may modify, replace, suspend or discontinue all or part of the Services, including any features or functionality, where reasonably necessary for operational, commercial, carrier availability, product functionality, legal, safety, security, fraud or risk management reasons. We will provide reasonable advance notice of any material change that is adverse to you where reasonably practicable. Unless otherwise necessary because of legal, safety, security, fraud or service availability requirements, a change, suspension or discontinuation will not affect a label already purchased or a transaction for which the Services have already commenced.
26. Amendments to these Terms. eBay may amend these Terms from time to time in accordance with the provisions of the eBay User Agreement governing changes to additional terms and policies. We will notify you of material amendments as required under those provisions.
27. Available Remedies. Without limiting any other remedies available to eBay under the eBay Policies or applicable law, eBay may restrict, suspend or terminate your access to the Services, or take other reasonable action in relation to your use of the Services, if eBay reasonably determines that you have breached these Terms, the eBay Policies, the Carrier Terms or carrier requirements, or applicable law, or where reasonably necessary to address fraud, misuse, safety or security risks.
28. Effect of Termination. Any termination, suspension or discontinuation of the Services will not affect any rights or obligations that accrued before it took effect, including any amounts owed, refunds due or Seller Protection claims relating to transactions or shipments commenced before that time. Any provision of these Terms which by its nature is intended to survive termination will continue to apply.
29. Governing Law and Jurisdiction. These Terms are governed by the laws of New South Wales, Australia. You and eBay submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia. Any contract between you and a carrier for a shipping service purchased through eBay is governed by the governing law and jurisdiction provisions in the applicable Carrier Terms.

eBay Delivery Network, powered by Orange Connex
Where the shipping service is provided by a third-party carrier through eBay Delivery Network, the applicable Orange Connex and carrier terms govern that shipping service. eBay acts as an agent in making that shipping service available to you.
