Terms & Conditions

The Authenticity Guarantee service for Watches (“Authenticity Guarantee” or “Authenticity Guarantee for Watches”) makes inspection and authentication services (“Services”) mandatory for certain items that meet the applicable $2,500 eligibility threshold. For eligible watches that meet the applicable threshold between AU $1,000 and AU $2,499.99, Authenticity Guarantee is available as an optional, add-on service and is not mandatory.

These Authenticity Guarantee Terms and Conditions (“Terms”) apply to the Authenticity Guarantee service for Watches and Authenticity Guarantee Eligible Items (description in Section 6.1 below) sold and purchased on eBay.com.au and set out the terms on which eBay offers you access to and use of the Authenticity Guarantee service for Watches.

  1. Applicability of eBay User Agreement and Other Policies.
    The eBay.com.au User Agreement, eBay’s User Privacy Notice, eBay’s prohibited and restricted items policies and all other policies posted on our websites (collectively, and as the same may be amended from time to time, “eBay’s Policies”) apply in addition to these Terms. In the event of a conflict or inconsistency between these Terms and eBay’s Policies, these Terms will control as to all matters that they explicitly address. For all matters not explicitly addressed by these Terms, eBay’s Policies will control.
  2. Applicability of eBay’s Money Back Guarantee.
    For authenticated items, eBay Money Back Guarantee only covers items returned within the seller’s return window and items that satisfy the eBay Money Back Guarantee eligibility requirements and are not received or that arrive damaged. Learn more about eBay Money Back Guarantee.
  3. Description of the Authenticity Guarantee Service.
    After the purchase of an Authenticity Guarantee Eligible Item (description in Section 6.1 below) on eBay.com.au, the item is sent to an authentication facility (“Authentication Facility”) to carefully inspect the item’s authenticity and conformity to the item’s listing details. Upon confirmation of the item’s authenticity by the Authentication Facility, the item is securely sent to the buyer. If the item’s authenticity cannot be verified or the item is not as described, the item is returned to the seller and a refund is issued.
  4. Description of the Services.
    The Services are provided by an authentication team for Authenticity Guarantee Eligible Items purchased and delivered within Australia. Within two (2) business days of receipt, our authentication team will inspect the watch for accuracy against the item listing by checking logos, tags, materials, hardware, quality and more as applicable, and for accuracy against the item listing. The authentication team will not inspect the watch for waterproofing or accuracy of the timekeeping. The authentication team will not verify the authenticity of any aftermarket documentation of provenance. As part of the Services, information relating to an Eligible Item, including unique identifiers such as serial numbers, may be checked against available databases or other sources for purposes including helping to identify items that may have been reported lost or stolen, detecting potential fraud or other policy violations, and protecting users and the safety and integrity of the eBay marketplace.

Items may also be photographed for use by eBay or its licensees as part of eBay’s image catalogue or for any other purpose, at eBay’s exclusive discretion.

By listing for sale or purchasing an Authenticity Guarantee Eligible Item, you acknowledge and agree that the Eligible Item is sent to the Authentication Facility for an authentication team to perform the Services. The Services are provided at no cost to sellers and buyers for Authenticity Guarantee Eligible Items that are bought or sold on eBay.com.au at a price of AU $2,500 or more. The Services may be purchased for a fee of AU $100.00 to buyers as an add-on for eligible items bought on eBay.com.au and priced between AU $1,000 and AU $2,499.99. eBay reserves the right to institute, alter or amend fees or costs associated with the Services, at any time, at eBay’s sole discretion. In the event eBay amends the fees or costs associated with the Services, eBay will post such changes on eBay Announcements 30 days in advance and eBay will notify users who are materially affected by the fee changes through eBay Messages and directly to the email address linked to their eBay account. If you do not accept the revised fees, you must immediately take steps to adjust your selling activity (such as ending Authenticity Guarantee listings). Where you have outstanding listings at the time of the fee change taking effect, you agree that the revised fees will apply to such listings until you remove those listings. Authenticity Guarantee fees and any applicable taxes for the optional add-on Service are non-refundable for returns initiated by buyers after passing the Services, except where otherwise required by law. If the item does not pass the Services, the fees will be refunded to the buyer in full.

  1. Eligibility.
    1. Item Eligibility.
      Only select listings on eBay.com.au are eligible for Authenticity Guarantee which can depend on matters such as the nature and value of a particular item and the availability of appropriately qualified authenticators. eBay reserves the right at any time, in its sole discretion, to alter or amend the eligibility requirements for Authenticity Guarantee Eligible Items, including, but not limited to the category and/or value of items and/or transactions. In the event eBay materially amends the eligibility requirements for Eligible Items (e.g. price thresholds), eBay will post such changes on eBay Announcements 30 days in advance and will notify users who are materially affected by the changes through eBay Messages and directly to the email address linked to their eBay account. 

      Eligible Items must meet the following criteria:

i. Category: Wristwatches.
ii. Price: Watches that meet the applicable listing eligibility threshold of  AU $2,500 or more are eligible for mandatory Authenticity Guarantee. Watches priced between AU $1,000 and AU $2,499.99 are eligible for the optional Authenticity Guarantee add-on service. Eligibility is not necessarily determined by the final transaction price and may depend on factors including the Buy It Now price or, for auction-style listings, the applicable reserve price. The following items are not eligible for Authenticity Guarantee:

i. Items not bearing the Authenticity Guarantee badge or otherwise identified as eligible for the optional add-on service;

ii. Smart watches, watch parts and accessories;

iii. Miscategorised items;

iv. Customised watches;

v. Items purchased using an offline payment method;

vi. Listings that offer local pickup;

vii. Items delivered to a P.O. Box; and

viii. Items delivered to an address outside Australia.

Ineligible items will not be authenticated. eBay may refuse to accept ineligible items and may take reasonable steps to return any ineligible item sent to the Authentication Facility. If an ineligible item cannot reasonably be returned after reasonable attempts to contact the relevant user, eBay reserves the right to donate or otherwise dispose of the item as permitted by applicable law. eBay reserves the right to charge sellers for costs associated with processing miscategorised items or impose additional consequences, including account suspension, where items are improperly routed to avoid Authenticity Guarantee.

  1. Country Eligibility.
    Authenticity Guarantee is not available for all countries. eBay reserves the right to expand or limit the countries eligible for Authenticity Guarantee program or at any time, in its sole discretion, with or without notice.   2. Party Roles
    1. Your Role as Seller.
      By listing an Eligible Item for sale on the eBay platform, you authorise its inspection by the authentication team subsequent to its purchase. Upon purchase, you are required to deliver the Eligible Item, with appropriate insurance coverage, to a located within Australia, as directed by eBay. The cost of shipping to the Authentication Facility is not covered by eBay. You acknowledge and agree that if the authentication team cannot verify an item’s authenticity, a refund will be issued to the buyer and you will cooperate by removing the item from marketplace circulation.
    2. Your Role as Buyer.
      By purchasing an Eligible Item on the eBay platform, you acknowledge and agree to inspection and photographing of the Eligible Item by the authentication team prior to your receipt of the Eligible Item. In addition, if a return is requested, you acknowledge and agree to send the Eligible Item, with appropriate insurance coverage, to and to the inspection of the Eligible Item by the authentication team before the return is processed or a refund is issued.     3. Circumvention of Buyer and Seller Requirements.
      If buyer or seller circumvent or do not comply with Sections 7.1 or 7.2 of these Terms, or if buyer or seller violate or are found to be non-compliant with the Terms, eBay reserves the right to take immediate action such as, but not limited to, account restriction or suspension or the transfer of fees and costs associated with Authenticity Guarantee. If you believe that action taken by eBay under this clause has been incorrectly applied, you should contact Customer Service and provide your reasons. eBay will consider such requests in good faith.
    4. Impact of Fraud Detection on Buyers and Sellers.
      You acknowledge and agree that if our authentication team detects fraud or is unable to authenticate the item, or identifies information indicating that the item may have been reported lost or stolen, the item will be removed from marketplace circulation and neither the buyer nor seller will receive the item. In addition, eBay will work with the appropriate authorities as needed and reserves the right, where permitted by applicable law, to confiscate and destroy any items unable to be authenticated. 
  3. Data Privacy.
    eBay’s collection of personal information in connection with the Authenticity Guarantee program is governed by the User Privacy Notice that applies to your use of the eBay.com.au website or, as applicable, another eBay international website. In order for the Authentication Facility to provide the Services under the Program, the order and item information, including, but not limited to your name, address, email address, telephone number and item identifiers such as serial numbers, may be provided to the Authentication Facility. By selling or purchasing an Eligible Item, you direct eBay to provide this order and item information to the Authentication Facility, who may disclose this information, however collected, to its affiliates, service providers and other third parties (such as shipping carriers and revenue authorities) as necessary to perform the Services.
  4. Lost, Damaged or Items Not Delivered.
    Items that are lost or damaged during the Authenticity Guarantee process are covered by eBay Money Back Guarantee, subject to the eBay Money Back Guarantee eligibility and guidelines. If a buyer or seller refuses to accept delivery of a package sent to his/her address on file or is otherwise unable to be reached, eBay will use commercially reasonable efforts to contact the buyer or seller and will consider the property abandoned after thirty (30) days. Once abandoned, the buyer or seller relinquishes all right, title or interest in the item and authorises eBay to dispense of the item as eBay sees fit.
  5. Program Updates and Discontinuation.
    eBay has the right, but not the obligation, to alter, amend, replace, suspend temporarily or permanently discontinue Authenticity Guarantee, the name of Authenticity Guarantee, any of the Services, features or functionality offered as part of Authenticity Guarantee, and/or the service providers used to provide the Services, where eBay determines, acting reasonably, that it is commercially or operationally necessary to do so..

Generally, eBay will provide 30 days' prior notice of changes made under this clause. However, the notice period may depend on the nature of the change and the circumstances giving rise to it. eBay will notify users who are materially affected through eBay Messages and directly to the email address linked to their account and/or through eBay Announcements.

If you do not accept the changes, you should take steps to adjust your activity, such as ending listings affected by the change. Where you have outstanding listings when a change takes effect, the change will apply to those listings unless and until you remove them.

  1. eBay Entity.
    The Authenticity Guarantee service is offered by eBay Marketplaces GmbH, Helvetiastrasse 15/17, 3005 Bern, Switzerland (“eBay”).

The Authenticity Guarantee service for Handbags (“Authenticity Guarantee” or “Authenticity Guarantee for Handbags”) makes inspection and authentication services (“Services”) mandatory for certain items sold on eBay.com.au. These Authenticity Guarantee Terms and Conditions (“Terms”) apply to the Authenticity Guarantee service for Handbags and Authenticity Guarantee Eligible Items detailed below sold and purchased on eBay.com.au, and sets out the terms on which eBay offers you access to and use of the Authenticity Guarantee service for Handbags.

  1. Applicability of eBay User Agreement.

  3. Description of the Authenticity Guarantee Service.
    > After the purchase of an Eligible Item (described in Section 6(a) below) on eBay.com.au, the item is sent to our Authenticators to carefully inspect the item for authenticity and accuracy against the item's listing details. Upon confirmation of the item by the Authenticators, it is appropriately packaged and securely sent to the buyer. If the item's authenticity cannot be verified or the item is not as described, the item is returned to the seller, and a refund is issued. >
  4. Description of the Services.
    The Services are provided at an authentication facility (“Authentication Facility”) by our authentication team (“Authenticators”) for Eligible Items (as detailed in Section 6(a) below) purchased and delivered within Australia. The Authenticators will inspect the item within two (2) business days of receipt at the Authentication Facility. This check will include inspection of the Eligible Item for authenticity and accuracy against the item listing.
    Items may also be photographed for use by eBay or its licensees as part of eBay's image catalog or any other purpose, at eBay's exclusive discretion.
    By listing for sale or purchasing an Eligible Item, you acknowledge and agree that the Eligible Item is sent to the Authenticators to perform the Services. More information about the Services may be found at our Authenticity Guarantee for Handbags FAQs. eBay is not the supplier of products sold under Authenticity Guarantee. The eBay Money Back Guarantee policy and any other buyer protections we provide as part of Authenticity Guarantee are in addition to any rights you may have against the seller under Australian Consumer Law.
  5. Authenticity Guarantee Program Fees.
    The Services are provided at no cost to sellers and buyers for Eligible Items purchased or sold on eBay.com.au. However, eBay reserves the right to institute, alter or amend fees or costs associated with the Services, at any time, at eBay’s sole discretion. In the event eBay amends the fees or costs associated with the Services, eBay will post such changes on eBay Announcements 30 days in advance and eBay will notify users who are materially affected by the fee changes through eBay Messages and directly to the email address linked to their eBay account.

  6. Eligibility.

      Only select listings on eBay.com.au are eligible for the Service which can depend on matters such as the nature, value and brand of a particular item and the availability of appropriately qualified authenticators. eBay reserves the right at any time, in its sole discretion, to alter or amend the eligibility requirements for Eligible Items, including, but not limited to the category and/or value of items and/or transactions.
      Only selected items are eligible at the current time, although Authenticity Guarantee will be expanding to cover more items. In the event eBay materially amends the eligibility requirements for Eligible items (eg brands, price threshold), eBay will post such changes on eBay Announcements 30 days in advance and eBay will notify users who are materially affected by the changes through eBay Messages and directly to the email address linked to their eBay account. If you do not accept the revised eligibility requirements you must immediately take steps to adjust your selling activity (such as ending Authenticity Guarantee listings). Where you have listings on site at the time of the change to eligibility requirements taking effect, you agree that the revised eligibility requirements will apply to such listings.
      Eligible Items include items that meet all of the following criteria:
      1. Brands: Louis Vuitton, Chanel, Gucci, Hermes, Saint Laurent, Celine, Dior, Prada, Fendi, Goyard, Burberry, Chloe, Valentino, Givenchy, Balenciaga, Bottega Veneta, MCM, Ferragamo, Salvatore Ferragamo, Loewe, Judith Lieber, Christian Louboutin, Dolce&Gabbana, Versace, Alexander McQueen, Mulberry, The Row, Off-white, Stella McCartney, Jimmy Choo, Proenza Shouler, Delvaux, Miu Miu, Mark Cross, Marni, Lanvin, Jill Sander, Bvlgari, Tom Ford, Balmain, Coach, Jacquemus and Alexander Wang..
      2. Price: Sold for AUD $330 or more.
      3. Item condition: New or preowned condition.
      4. Category: Women's Bags & Handbags, Men's Bags & Briefcases, Men's Wallets and Women’s Wallets, Handbag accessories, ID/Document holders, Key chains, Rings & Finders, Belts, Hats, Organisers, & Day Planners
    2. The following items are not eligible for Authenticity Guarantee:
      1. Items not bearing the Authenticity Guarantee badge on the listing
      2. Handbags listed in categories not named above
      3. Miscategorised items, e.g. other types of bag such as luggage
      4. Customised/ personalised Handbags
      5. Items purchased using an offline payment method
      6. Listings that offer local pickup
      7. Items delivered to an address outside Australia
    3. Ineligible items will not be authenticated. eBay reserves the right to charge sellers for costs associated with processing miscategorised items or impose additional consequences, including account suspension when items are improperly routed to avoid Authenticity Guarantee.
    4. Country Eligibility.
      The Authenticity Guarantee program is not available for all countries. eBay reserves the right to expand or limit the countries eligible for the Authenticity Guarantee or the Services at any time, in its sole discretion, with or without notice. At this time, only items located within Australia are eligible for the Australian Authenticity Guarantee program.
  7. Party Roles

The cost of shipping to the Authentication Facility is not covered by eBay. You acknowledge and agree that if the Authenticators cannot verify an item's authenticity, a refund will be issued to the buyer and you shall cooperate with removing the item from marketplace circulation.
    2. Your Role as Buyer.
      By purchasing an Eligible Item on the eBay platform, you acknowledge and agree to inspection and photographing of the Eligible Item by the Authenticators prior to your receipt of the Eligible Item. In addition, if a return is requested, you acknowledge and agree to send the Eligible Item as directed by eBay, for inspection of the Eligible Item by the Authenticators before the return is processed or a refund is issued.   8. Data Privacy.

By selling or purchasing an Eligible Item, you direct eBay to provide this order information to the Authenticators, who may disclose this information, however collected, to its affiliates, service providers, and other third parties (such as shipping carriers and revenue authorities) as necessary to perform the Services.
  9. Lost, Damaged, or Items Not Delivered.
    Items lost or damaged during the Authenticity Guarantee process are protected by eBay's Money Back Guarantee, subject to the eBay Money Back Guarantee guidelines.
  10. Service Updates and Discontinuation.
    eBay has the right, but not the obligation, to alter, amend, replace, suspend temporarily, and/or discontinue permanently, the Authenticity Guarantee service, the name of Authenticity Guarantee, any of the Services provided, features, and/or functionality offered under Authenticity Guarantee, and/or the service providers used to provide any or all of the Services under Authenticity Guarantee where eBay determines, acting reasonably, that it is commercially or operationally necessary to do so. Generally eBay will provide You with 30 days’ prior notice of any changes made under this clause however the time frame for notices under this clause will depend on the nature of the change and the circumstances giving rise to the need to change the Services and/or Authenticity Guarantee program. We will notify users who are materially affected by the changes through eBay Messages and directly to the email address linked to their account, and/or via eBay Announcements.
    If you do not accept the changes, you should take steps to adjust your activity (such as ending listings affected by an amendment). Where You have outstanding listings at the time of the amendment taking effect You agree that the amendments will apply to such listings unless and until you remove those listings.

The Authenticity Guarantee service for Sneakers ("Authenticity Guarantee" or "Authenticity Guarantee for Sneakers") makes inspection and authentication services (the "Services") mandatory for certain items sold on eBay.com.au. These Authenticity Guarantee Terms and Conditions ("Terms") apply to the Authenticity Guarantee service for Sneakers and Eligible Items detailed below and sold or purchased on eBay.com.au, and set out the terms on which eBay offers you access to and use of the Authenticity Guarantee service for Sneakers.

  1. Applicability of eBay User Agreement.

The eBay.com.au User Agreement, eBay's User Privacy Notice, and all policies posted on our sites (collectively, and as the same may be amended from time to time, "eBay's Policies") apply in addition to these Terms. If you have an issue with your authenticated item outside the eBay Money Back Guarantee time frames, please contact eBay Customer Service as you may be eligible for some additional protections.

  1. Description of the Authenticity Guarantee Service.

After the purchase of an Eligible Item (description in Section 6(a) below) on eBay.com.au, the item is sent to our Sneaker Con Authenticators to carefully inspect the item for authenticity and accuracy against the item listing. Upon confirmation of the item by the Authenticators, it is properly packaged and securely sent to the buyer. If the item's authenticity cannot be verified or the item is significantly not as described, the item is returned to the seller by the Authenticators and a refund is issued.

  1. Description of the Services.

The Services are provided by our authentication team (“the Authenticators”) for Eligible Items purchased and delivered to an Australian address. The Authenticators will inspect the item within two (2) business days of receipt at their facilities. This check will include inspection of the shoe for authenticity and accuracy against the item listing. Accessories such as laces will not be authenticated if they are noted in the listing as replacements. In such cases, the condition of accessories will instead be verified against the listing.

Items may also be photographed for use by eBay or its licensees as part of eBay's image catalogue or for any other purpose, at eBay's exclusive discretion.

By listing for sale or purchasing an Eligible Item, you acknowledge and agree that the Eligible Item will be sent to the Authenticators to perform the Services. More information about the Authenticators and Services may be found in our Authenticity Guarantee FAQs. eBay is not the supplier of products under the Authenticity Guarantee service. The eBay Money Back Guarantee policy and any other buyer protections we provide as part of the Authenticity Guarantee service are in addition to any rights you may have against the seller under Australian Consumer Law.

Only items from select sellers are eligible at the current time, although Authenticity Guarantee will be expanding to all sellers in sneakers. Check listings for the "Authenticity Guarantee" blue tick badge to see if listings on eBay.com.au are Eligible Items from a particular seller areand included in the Service at this time.

In the event eBay materially amends the eligibility requirements for Eligible Items (eg brands, price threshold), eBay will post such changes on eBay Announcements 30 days in advance and eBay will notify users who are materially affected by the changes through eBay Messages and directly to the email address linked to their eBay account.

If you do not accept the revised eligibility requirements you must immediately take steps to adjust your selling activity (such as ending Authenticity Guarantee listings). Where you have listings on site at the time of the change to eligibility requirements taking effect, you agree that the revised eligibility requirements will apply to such listings.

ii. Price: $140+, excluding postage and any applicable taxes

iii. Condition: New and Pre-Owned

iv. Category: Men's Athletic Shoes, Women's Athletic Shoes, Unisex Kids’ Shoes, Girls’ Shoes, Boys’ Shoes, Baby Shoes.

b. The following items are not eligible for Authenticity Guarantee:

i. Items not bearing the Authenticity Guarantee badge

ii. Sneakers listed in categories not named above

iii. Miscategorised items, e.g. other types of shoes listed in eligible categories

iv. Modified sneakers

v. Signed sneakers

vi. Items purchased using an offline payment method

Items shipping from the United States exceeding $2,500 USD are not eligible for Authenticity Guarantee at this time.

c. Country Eligibility.

The Authenticity Guarantee service is not available for buyers and sellers in all countries. eBay reserves the right to expand or limit the countries eligible for buying or selling with Authenticity Guarantee or using the Services at any time, in its sole discretion, with or without notice.

  1. Party Roles

a. Your Role as Seller.

By listing an Eligible Item for sale on the eBay platform, you authorise its inspection by the Authenticators subsequent to its purchase.

Upon purchase, you are required to deliver the Eligible Item to the Authenticators as directed by eBay. Items must be sent to the facility individually unless part of a multi-quantity order. The cost of postage to the Authenticators is not covered by eBay. You acknowledge and agree that if the Authenticators cannot verify an item's authenticity, a refund will be issued to the buyer and you shall cooperate with removing the item from marketplace circulation.

b. Your Role as Buyer.

By purchasing an Eligible Item on the eBay platform, you acknowledge and agree to inspection and photographing of the Eligible Item by the Authenticators prior to your receipt of the Eligible Item. In addition, if a return is requested, you acknowledge and agree to send the Eligible Item as directed by eBay and to the inspection of the Eligible Item before the return is processed or a refund is issued. c. Circumvention of Buyer and Seller Requirements.

If buyer or seller circumvent or do not comply with Sections 7.a or 7.b of these Terms, or if buyer or seller violate or are found to be non-compliant with the Terms, eBay reserves the right to take immediate action such as, but not limited to, account restriction or suspension. If you believe that eBay actions taken under this clause have been incorrectly applied you should contact Customer Service providing your reasons. eBay will consider such requests in good faith.

  1. Data Privacy.

eBay's collection and processing of personal information in connection with the Authenticity Guarantee service is governed by the User Privacy Notice that applies to your use of the eBay.com.au website or, as applicable, another eBay international site. For items purchased that qualify for the Authenticity Guarantee service, eBay will share your order information, including but not limited to your name, address, email address and telephone number with the Authenticators in order for it to provide the Services. By selling or purchasing an Eligible Item, you direct eBay to provide this order information to the Authenticators, who may disclose this information, however collected, to its affiliates, service providers, other third parties (such as shipping carriers and revenue authorities) as necessary to perform the Services.

  1. Lost, Damaged, or Items Not Delivered.

Items that are lost or damaged during the Authenticity Guarantee process are protected by eBay Money Back Guarantee, subject to the eBay Money Back Guarantee guidelines.

  1. Service Updates and Discontinuation.

eBay has the right, but not the obligation, to alter, amend, replace, suspend temporarily, and/or discontinue permanently, the Authenticity Guarantee service, the name of Authenticity Guarantee, any of the Services provided, features, and/or functionality offered under Authenticity Guarantee, and/or the service providers used to provide any or all of the Services under Authenticity Guarantee where eBay determines, acting reasonably, that it is commercially or operationally necessary to do so. Generally eBay will provide You with 30 days’ prior notice of any changes made under this clause however the time frame for notices under this clause will depend on the nature of the change and the circumstances giving rise to the need to change the Services and/or Authenticity Guarantee program. We will notify users who are materially affected by the changes through eBay Messages and directly to the email address linked to their account, and/or via eBay Announcements.

If you do not accept the changes, you should take steps to adjust your activity (such as ending listings affected by an amendment). Where You have outstanding listings at the time of the amendment taking effect You agree that the amendments will apply to such listings unless and until you remove those listings.
