Terms and conditions
These terms and conditions (“Terms”) apply to the eBay Best Price Guarantee on ebay.com.au (the “Site”).

  1. Applicability of eBay User Agreement
    The eBay.com.au User Agreement, eBay's User Privacy Notice, and all policies posted on our sites (collectively, and as the same may be amended from time to time, "eBay's Policies") apply in addition to these Terms. In the event of a conflict or inconsistency between these Terms and eBay's Policies, these Terms will prevail over all matters that they explicitly address. For all matters not explicitly addressed by these Terms, eBay's Policies will prevail.
  2. Description of eBay’s Best Price Guarantee
    If you are an Eligible Buyer who purchased an Eligible Item and then found it on an Approved Retailer’s website for a lower price (including shipping costs) within 48 hours of purchase, you can submit a Best Price Guarantee claim (“Claim”). 
    If your claim is verified and approved by eBay, eBay will issue you a voucher equal to the difference between the eBay Purchase Price (defined below) and the Approved Retailer’s price PLUS an additional 5% off the Approved Retailer’s price (excluding GST) (“Voucher”). For the avoidance of doubt, the maximum voucher value is AUD $150.
    eBay Purchase Price” means the actual price that you paid for the Eligible Item on the Site including shipping costs, after applying any valid coupon, voucher, discount code or credit and including GST.
  3. Eligibility
    eBay Best Price Guarantee is only available to users who:
    • have Australia or New Zealand as their registered address on the “Site”; 
    • have purchased an Eligible Item on the Site; and 
    • have had that Eligible Item shipped to an Australian address (together, "Eligible Buyer/s"). 
  4. Eligible Items” means new, fixed price items listed on the Site.
  5. Approved Retailers” means any online retailer listed on https://pages.ebay.com.au/best-price-guarantee/, as amended from time to time.
  6. Submitting a claim
    • To submit a Claim, Eligible Buyers must contact eBay Customer Service via this link: https://www.ebay.com.au/help/contact_us?id=4002&st=10. Eligible Buyers must ensure to:
    • submit the Claim within 48 hours of purchasing the Eligible Item;
    • provide the transaction ID or item number from the eBay order confirmation; and
    • provide a link to a bona fide listing of the identical item from an Approved Retailer’s website (“Identical Item”).
  7. eBay Best Price Guarantee Claim Conditions
    A Claim is only valid if, at the time eBay verifies the Claim, all of the following conditions are met:
    • both the Eligible Item that was purchased and the Identical Item must be new, offered via a fixed-price selling format (i.e. not an auction) and verified to be identical by reference to a universal product identifier (such as a UPC or brand and manufacturer part number);
    • the Identical Item must be in stock on the Approved Retailer’s website; 
    • the Identical Item must be available for delivery to the buyer’s Australian address; and
    • the Approved Retailer’s advertised price (including shipping costs but excluding GST) is lower than the price paid on eBay (including shipping costs and after discounts).
  8. Claim limits 
    Eligible Buyers can make a maximum of one Claim per day and a maximum of ten (10) Claims in any calendar month (together, the “Claim Limits”). The Claim Limits will be strictly enforced, and any effort or collusion by any user to circumvent these Terms, commit fraud or abuse the Best Price Guarantee program will result in their removal from eligibility for the initiative and the cancellation of any vouchers issued under the offer.
  9. Voucher issue
    If your Claim is verified by eBay as meeting all of the above conditions, an eBay Customer Service agent will issue you a voucher in accordance with these Terms.
  10. Voucher conditions
    The Voucher:
    • is not transferable and cannot be redeemed for cash or withdrawn into your bank account;
    • cannot be used in conjunction with any other eBay voucher or offer; 
    • is redeemable only on the Site; and is valid from the date of issue and will expire ninety (90) days from the date of issue (“Validity Period”). Any voucher which is not redeemed by the end of the Validity Period will cease to be valid.
  11. Voucher Redemption
    To redeem the Voucher, enter the redemption code provided to you by eBay Customer Service into the redemption code box during the checkout process. The code cannot be used in conjunction with any other eBay offer, coupon or voucher, however it may be used in conjunction with a seller coded coupon or offer, subject to any applicable terms and conditions. You can only use the code once during the Validity Period. Where a transaction for which a redemption code has been used is cancelled either by you or a seller, the redemption for the cancelled transaction cannot be re-used and will still be considered a redemption as set out in the Cancellations clause below. The code is provided to you as an eBay User and the limitations on its usage apply on that basis even though you may have registered a number of different eBay User IDs.
  12. General
    • eBay rights. Without limiting other remedies and in addition to eBay's rights under the User Agreement, eBay reserves the right to prohibit access to this initiative, reverse a price match and cancel any voucher issued in circumstances where eBay believes, in its sole discretion (to be exercised reasonably and in consideration of all the circumstances):
      • you have provided false information, conspired with others to gain an unfair advantage or have otherwise been involved in any way in manipulating, interfering or tampering with the conduct of this initiative;
      • a sale or purchase of any item as part of this initiative has not been made in good faith, including where eBay considers that the buyer and seller may be related parties (such as family members or parties sharing the same dwelling); or
      • buyers or sellers have engaged in collusive conduct or any other conduct which eBay considers unfair, fraudulent or untoward.
    • Returns. If you return or seek a refund on any item purchased using the Voucher, the value of the Voucher will not be refunded to you.
    • Cancellations. If you redeem the Voucher and the transaction is subsequently cancelled, the value of the Voucher will not be refunded to you and the transaction will still be considered a redemption under the Voucher Redemption clause above. If you have redeemed the Voucher on a transaction which has subsequently been cancelled for reasons outside of your control, you may contact us, providing reasons, to request a replacement voucher.
    • Liability. To the extent permitted by law, eBay will not be responsible for any loss incurred by you in redeeming or attempting to redeem the Voucher or for any costs, damages, accident, delay, injury, loss, expense, or inconvenience that may arise in connection with the use of the Voucher or participation in the initiative.
    • Changes. eBay reserves the right, at its reasonable discretion, to vary these terms and conditions, or to cancel or change the initiative at any time. eBay will only vary these terms and conditions, or cancel or change the initiative where it determines, acting reasonably, that it is necessary to do so to prevent fraud, misuse or abuse of the initiative, to correct any error or mistake, or where it is necessary to do so to protect eBay’s legitimate interests. Unless it is necessary to update these terms and conditions to correct a mistake or error, or to urgently cancel or change the initiative such as in the case of fraudulent activity, eBay will provide 48 hours’ notice (“Notice Period”) by publishing revised terms on eBay.com.au. If you do not agree to the variation or change to the initiative, you must cease participation in the initiative during the Notice Period. Notwithstanding the foregoing, any initiative which does not have an end date specified at the time of launch or is promoted as a limited time only offer, will not have an indefinite duration and may be ended by eBay at any time. It is your responsibility to check whether an offer or initiative is still available before proceeding to purchase.
    • Monetary amounts. All monetary amounts specified in these terms and conditions are in Australian dollars (AUD).
    • Jurisdiction. The parties submit to the non-exclusive jurisdiction of the courts of the state of New South Wales.
