Best Price Guarantee Terms & Conditions

Our goal is to make sure you think of eBay first when you shop. We're so confident in our sellers' prices that, for a limited time only, if Eligible Buyers (defined below) buy an Eligible Product (defined below) and then find it for less than they paid for it on an Approved Retailer's website (including shipping costs) within 48 hours, we'll beat it by 5%. Approved Retailer means any online retailer listed on https://pages2.ebay.com.au/Best_Price_Promise, as amended from time to time.

The eBay Best Price Guarantee applies to the actual price that you paid for the Eligible Product on eBay.com.au (including shipping costs), after applying any valid coupon, voucher, discount code or credit.

For example, if you are an Eligible Buyer and pay $100 for an Eligible Product during the Promotion Period but then see it within 48 hours on an Approved Retailer's website for $90 (including shipping costs), we'll give you an eBay voucher (redeemable on www.ebay.com.au) for the difference plus an additional 5% of the Approved Retailer's price (excl GST). In this example, the total eBay voucher value will be $14.50 (i.e. $10 for the difference, plus 5% of $90 = $4.50).

This offer will be available for Eligible Buyers from 10.00 (AEST) 2nd July 2018 for the limited period that is displayed on www.ebay.com.au (the “Promotion Period”) and applies to purchases of new, fixed price items listed on www.ebay.com.au ("Eligible Product"). Only one Eligible Product per eBay buyer per day is permitted to receive a voucher under this offer.

Without limiting other remedies and in addition to eBay's rights under the User Agreement, eBay reserves the right to prohibit access to this offer, reverse a price match and cancel any voucher issued in circumstances where eBay believes, in its sole discretion (to be exercised reasonably and in consideration of all the circumstances):

• you have provided false information, conspired with others to gain an unfair advantage or have otherwise been involved in any way in manipulating, interfering or tampering with the conduct of this offer;
• a sale or purchase of any item as part of this offer has not been made in good faith, including where eBay considers that the buyer and seller may be related parties (such as family members or parties sharing the same dwelling); or
• buyers or sellers have engaged in collusive conduct or any other conduct which eBay considers unfair, fraudulent or untoward.

Covered

During the Promotion Period, we will give you an eBay voucher for the difference + 5% of the Approved Retailer's website price (including shipping costs but excluding GST) under the eBay Best Price Guarantee up to a maximum of $150 when:

• the request is from an active and registered eBay.com.au account holder who: is an Australian resident, has purchased an Eligible Product on ebay.com.au, and has had that Eligible Product shipped to an Australian address ("Eligible Buyer"). Eligibility is limited to Eligible Products;
• within 48 hours of purchasing an Eligible Product, the eBay buyer locates a bona fide listing of an identical product from an Approved Retailer which is listed on the Approved Retailer's official website;
• both the Eligible Product that was purchased and the identical product on an Approved Retailer's website are verified by an eBay customer service agent at the time the price-check is conducted as being: new condition, fixed price, identical by a universal product identifier (e.g. UPC or brand + manufacturer part number), in-stock on the Approved Retailer's website and available to ship to the buyer's Australian address;
• the Eligible Product is advertised on the Approved Retailer's website at a price (including shipping costs but excluding GST) that is less than the price you paid (including shipping costs) for the Eligible Product after applying any valid coupon, voucher, discount code or credit;
• you have not made any more than 10 Best Grice Guarantee claims in any calendar month or more than one claim on the same dav (“Claim Limits”).

If your eBay Best Price Guarantee claim is verified and accepted by an eBay customer service agent, you will receive an eBay voucher for an amount calculated in accordance with these terms and conditions. The voucher cannot be used in conjunction with any other eBay voucher or offer, nor can it be redeemed for cash. It is only redeemable on ebay.com.au and will expire 90 days after its date of issue. The maximum amount permitted for a voucher is $150.

The Claim Limits will be strictly enforced, and any effort or collusion by any buyer or seller to circumvent these terms and conditions, commit fraud or abuse the Best Price Guarantee program will result in your removal from eligibility for the offer and the cancellation of any vouchers issued under the offer. By purchasing an Eligible Product, you agree to accept and be bound by these terms and conditions and to submit to the exclusive jurisdiction of the courts of the state of New South Wales.

Not Covered

• any product that is not an Eligible Product;
• Approved Retailer's prices after applicable rebates, free offers, coupons, competitor clearance products and stock liquidations from an Approved Retailer's website, specific offers based on bundled pricing, or where volume or lot discounts are applied;
• identical products listed by Approved Retailers or sellers in eBay store listings;
• an error or misprint on an Approved Retailer's website.

Subject to change

This Best Price Guarantee policy is subject to change, with such change to take effect 48 hours after revised terms have been published on eBay.com.au where these terms and conditions appear. eBay reserves the right to refuse an eBay Best Price Guarantee claim request in order to prevent fraud or abuse, and to ensure the integrity of the eBay website and safety of its users. All other eBay terms and conditions and policies apply.
