"Sell with PayPal Promotion" - Terms & Conditions.

Information on how to enter the Promotion forms part of these Terms and Conditions. Entry into the Promotion is deemed acceptance of these Terms and Conditions.

The Promotion commences at 12:01am (AEST) on 6 May 2008 and ends at 11:59pm (AEST) on 20 May 2008 (‘The Promotion Period’).

1. Entry is open to any Australian resident who is validly registered with an Australian address as a member of www.ebay.com.au (operated by eBay International AG (eBay)) AND who is also registered as a member of www.paypal.com.au (operated by PayPal Australia Pty Ltd) AND who successfully closes a sale on eBay.com.au which is paid for with PayPal during The Promotion Period (“Eligible Entrants”).
2. Employees (and their immediate family members) of eBay, PayPal, and agencies/companies associated with the conduct of this Promotion, and persons whose eBay or PayPal accounts have been temporarily or indefinitely suspended or made inactive by eBay or PayPal during the Promotion Period, are not eligible to enter the Promotion. Entrants must have a valid Australian PayPal account in order to be eligible to receive a prize. If the winner of a prize is under the age of 18 years, the prize may be awarded to the winner’s nominated parent or guardian. .
3. Eligible Entrants are responsible for ensuring that all their contact details registered with eBay and PayPal are correct. Eligible Entrants will forfeit their right to claim a prize in the event that their contact details are inaccurate. Eligible Entrants may check or update their contact information with PayPal by visiting the Profile tab on the PayPal site at http://www.paypal.com.au. Eligible Entrants may check or update their contact information with eBay by visiting the My Account section on the eBay site at http://www.eBay.com.au
4. Each successful sale with PayPal during the Promotional Period confers the right to one entry in the prize draw. Each subsequent successful sale equates to another entry in the draw. A sale includes items sold in either auction or fixed price formats. Store inventory is excluded.
5. There are two prize pools
   • To qualify for Prize Pool A: an entrant must have 1 or 2 eligible sales during the promotional period
   • For entry into prize pool B, an entrant must have 3 - 10 eligible sales during the promotional period. An entrant can have no more than 10 eligible entries into Prize Pool B.
   • An entrant can not qualify for both prize pools.
6. Any item which is purchased and subsequently cancelled, or for which a refund is subsequently sought, is ineligible to be included as a sale for the purpose of this Promotion. All Sales and Eligible Entrants must conform to eBay’s and PayPal’s policies and user agreements available at http://www.ebay.com.au and http://www.paypal.com.au.
7. The computerised random draw of Prizes will take place at 3pm (AEST) on Tuesday, 3 June 2008 at MDSA, 15 Grosvenor Street, Neutral Bay, NSW 2089. The winners will be randomly drawn from the pool of Eligible Entrants (the Winners), in descending order of maximum retail value.
8. The total number of prizes in Prize Pool A is 339 with a maximum retail value of $53,772.00. The total number of prizes in Prize Pool B is 111 with a maximum retail value of $145,980.30.
9. Total prize value is up to $199,752.30. Prize values are correct at time of printing. Promoter accepts no responsibility for any change in prize value after that date. Any prizes not claimed by 4 September 2008 will go into an Unclaimed Prize Draw which will take place at 3pm Sydney time on 19 September 2008.
10. Prize Pool A:
    • Total of 339 Prizes to be won.
    • Each entry goes into the draw to win a prize. Maximum of 2 entries per person (so each Eligible Entrant in Prize Pool A can win up to two prizes).
11. Prize Pool B:
    • Total of 111 Prizes to be won.
    • Each entry goes into the draw to win a prize.  Minimum of 3 and Maximum of 10 entries per person (so each Eligible Entrant in Prize Pool B can win up to ten prizes).

12. The following terms and conditions apply to the Qantas Domestic Holiday prizes:
    • The prize consists of: a Qantas Travel Voucher to the value of AUD $5,000.
    • Winners can use the voucher to buy outright, or put towards a Qantas holiday.
    • Qantas holiday conditions will apply.
    • The Voucher will be valid for 12 months from the date of the draw.
    • The maximum retail value of the voucher is AU$5,000 (including GST).
    • The prize is subject to flight and accommodation availability at time of booking.
    • It is a condition of accepting the prize that the winner and his/her travelling companions will be required to sign a release of liability in a form to be determined in the absolute discretion of the Promoter.
    • The Promoter accepts no responsibility for the cancellation or rescheduling of any flights.
    • The prize must be taken by the winner and the winner’s nominated partner as stated and cannot be transferred to another person, exchangeable for other goods and services or redeemed as cash. Any element of the prize which is unused will be forfeited and no compensation will be paid in lieu of that element of the prize.
13. The following terms and conditions apply to the Qantas Domestic Holiday prizes:
    • The prize comprises: a Qantas Travel Voucher to the value of AUD$10,000.
    • Winners can use the voucher to buy outright, or put towards a Qantas holiday.
    • Qantas holiday conditions will apply. Voucher will be valid for 12 months from the date of the draw
    • The maximum retail value of this prize is AU$10,000 (including GST).
    • The prize is subject to flight and accommodation availability at time of booking.
    • If a winner or travelling companion is under the age of 18 as at the date of the draw, an adult must accompany the minor in the participation of the prize.
    • It is a condition of accepting the prize that the winner and his/her travelling companions will be required to sign a release of liability in a form to be determined in the absolute discretion of the Promoter.
    • The Promoter accepts no responsibility for the cancellation or rescheduling of any flights.
    • The Promoter accepts no responsibility for any variation of any aspect of this prize, due to circumstances outside its control
    • The prize must be taken by the winner and the winner’s nominated partner as stated and cannot be transferred to another person, exchangeable for other goods and services or redeemed as cash. Any element of the prize which is unused will be forfeited and no compensation will be paid in lieu of that element of the prize.
    • Any expenditure or liability incurred in relation to any extras of a personal nature eg. tips, telephone, laundry etc. are the responsibility and liability of the winner and the winner’s nominated partner.
    • The prize must be organised and taken within twelve months of the prize draw or else will be void and may not be extended under any circumstances.
    • The winner and the winner’s nominated partner are responsible for ensuring that they can travel once the tickets have been issued and that all relevant travel documentation is obtained and valid (e.g. valid visas, passports). The Promoter takes no responsibility for any loss, liability or sanction resulting from the failure of the winner or the winner’s partner to obtain and maintain valid travel documentation (including insurance).
14. The following terms and conditions apply to the Weekend in a Capital City prize:
    • The prize comprises: A one night stay in a 4 Star Hotel of the Promoter’s choice, in an Australian Capital City, including a twin share room for one night, dinner for 2 in the Hotel on the same night and breakfast for 2 in the Hotel on the following morning.
    • The maximum retail value of this prize is AU$800 (including GST).
    • The prize is subject to accommodation availability at time of booking.
    • Unless otherwise specified as an element of the prize, meals, spending money (other than those specified), and all other ancillary costs are the responsibility of the winner and his/her companion.
    • It is a condition of accepting the first prize that the winner and his/her travelling companion will be required to sign a release of liability in a form to be determined in the absolute discretion of the Promoter.
    • The Promoter accepts no responsibility for any variation of any aspect of this prize, due to circumstances outside its control
    • The prize must be taken by the winner and the winner’s nominated partner as stated and cannot be transferred to another person, exchangeable for other goods and services or redeemed as cash. Any element of the prize which is unused will be forfeited and no compensation will be paid in lieu of that element of the prize. Unless otherwise stated as an element of the prize, the prize does not include travel, spending money, meals, including room service, hotel car parking, other hotel incidentals, ground transportation, taxes, insurance, gratuities, merchandise or any other costs of a related, ancillary or incidental nature.
    • Any expenditure or liability incurred in relation to any extras of a personal nature eg. tips, telephone, laundry etc. are the responsibility and liability of the winner and the winner’s nominated partner.
    • The prize must be organised and taken by 31st December 2008 or else will be void and may not be extended under any circumstances.
15. Winners will be notified via email of their Prizes. Their names will be published on the Promotional Boards on ebay.com.au on 10 June 2008 and in The Australian newspaper on 11 June 2008.
16. PayPal Credit prizes will be deposited within 1 month into the winning members’ PayPal account.
17. A Prize is not exchangeable for other goods and services or redeemable in cash.
18. An Unclaimed Prize Draw will take place at 3pm Sydney time on 19 September 2008 at 15 Grosvenor Street, Neutral Bay NSW 2089, in order to distribute any Prizes unclaimed by that date, subject to State regulations. Any Winners, resulting from the Unclaimed Prize Draw will be notified in writing of their Prizes and their names will be published on Promotional Boards on ebay.com.au on 26 September 2008.
19. All entries become the property of the Promoter. Each entrant consents to the Promoter and eBay using their personal information in order to conduct the Promotion. No further use of information collected solely from entries into the Promotion will be made beyond this Promotion by the Promoter or eBay. To facilitate an entrant’s participation, the Promoter may disclose an entrant’s personal information to other companies associated with this Promotion (including eBay) and where the Promoter deems it necessary to do so. If an entrant does not provide their personal information they will not be eligible in this Promotion. An entrant may access and correct any personal information held by the Promoter, upon request to the Promoter.
20. Entries are deemed to be received at the time of receipt into the Promoter's database. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission. The Promoter is not responsible for any problems or technical malfunction of any telephone, or computer network, lines, servers, or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to participants or any other person's handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this Promotion.
21. The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Terms and Conditions. The Promoter’s decision is final, and no correspondence will be entered into, including in the event of a dispute.
22. No responsibility will be accepted for late, lost or misdirected entries.
23. The Promoter is not responsible for any technical malfunctions or problem with internet congestion, including injury or damage to an entrant’s or any other person’s computer related to participation in this Promotion and any problems with transmission of entries over the internet.
24. The Promoter is not liable for any injury, loss or damage of any nature whatsoever (including but not limited to indirect or consequential loss) which is suffered or sustained as a result of or in connection with receiving, taking or using any prize, except for any liability which cannot be excluded by law. Any tax liability arising as a result of accepting any Prize is the responsibility of the Winner.
25. If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right in its discretion to modify the terms of the Promotion including the Prizes and these Terms and Conditions, subject to approval of the gaming authorities in each State and Territory where relevant.
