PayPal Holiday Giveaway Promotion Terms and Conditions
Who Can Enter?
1. Information on how to enter and the prizes form part of these Terms and Conditions of entry for the PayPal Holiday Giveaway (Promotion). Entry into the Promotion is deemed acceptance of these conditions of entry.
2. Entry is open to all residents of Australia whom are validly registered as an eBay member (eBay) AND are also registered as an Australian PayPal member (in accordance with all applicable Australian PayPal terms and conditions, policies and its User Agreement) (PayPal). Employees of eBay and PayPal and their immediate family members, associated agencies of this Promotion, persons whose eBay accounts have been temporarily or indefinitely suspended or made inactive by eBay during the Promotion Period, and companies associated with this Promotion are not eligible to enter the Promotion.
3. eBay and PayPal members are responsible for ensuring that all their contact details registered on eBay and PayPal are correct. eBay and PayPal members will forfeit their right to claim the prize in the event that their contact details are inaccurate or wrong. You may check or update your contact information with PayPal by visiting the Profile tab on the PayPal site. You may check or update your contact information with eBay by visiting the My Account section on the eBay site.
4. If the winner of a prize is under the age of 18 years, the prize will be awarded to the winner’s nominated parent or guardian.
How to Enter
5. To enter this Promotion simply use PayPal (located at: www.paypal.com.au) during the promotional period to pay for an item purchased on eBay. You will be automatically entered into the draw to win one of 5 money prizes on offer upon successful completion of a transaction with a seller. Entrants must have a valid Australian PayPal account in order to receive their prize money.
6. Multiple entries accepted but only one entry permitted per eBay item number (Item Number). PayPal payments must contain a valid eBay item number to qualify. All listings and members must conform to eBay’s and PayPal’s policies and user agreements. Refunded payments will not qualify.
Entry Periods
7. The total duration for this Promotion is between 00:00:01am AEDT Monday 21st November, 2005 and 11:59:59pm AEDT Sunday 25th December, 2005. (“Promotion Period”)
Prizes
8. At the conclusion of the promotion the entries will be divided into 5 separate weekly draws. Each specific weekly draw will include entries received during that week. The first valid entry drawn in each of the weekly draws will receive a AU $5,000 payment to the member’s PayPal account.
9. The total prize pool for the Promotion Period is AU $25,000.
10. Entrants must have a valid Australian PayPal account in order to receive their prize money which will be paid into their Australian PayPal account.
11. Prize money will be deposited within 1 month into the winning members’ PayPal account after the winning member has been successfully notified by the Promoter.
12. No other costs or expenses will be included in the Prizes.
When Is The Draw
13. The draw will be held at 3pm AEDT on 10th January 2006 at Level 19, 1 York St., Sydney NSW. The draw will be a random draw. Unclaimed prizes will be redrawn at 3pm AEDT on 10th May 2006 at Level 19, 1 York St., Sydney NSW in order to distribute any prizes unclaimed by that date, subject however to any written directions given under Reg 37 of the Lottery and Gaming Regulations 1993 (SA).
14. Prizes are not transferable or exchangeable.
How Will The Winners Be Announced?
15. The winners names will be published on this page (http://forums.ebay.com.au/forum.jspa?forumID=1007) and in The Australian newspaper on the 18th January 2006. All winners will receive e-mail (or, where possible, telephone) notification from the Promoter on the award dates specified above. Any winners in the unclaimed prize draw will have their names published in The Australian newspaper on the19th May 2006.
Privacy Policy
16. All entries become the property of the Promoter. Each entrant consents to the Promoter and eBay collecting their personal information in order to conduct the Promotion. No further use of this information will be made beyond this Promotion by the Promoter or eBay. To facilitate an entrant’s participation, the Promoter may disclose an entrant’s personal information to other companies associated with this Promotion (including eBay) and where the Promoter deems it necessary to do so. If an entrant does not provide their personal information, the Promoter will not be able to enter them into this Promotion.
Miscellaneous
17. The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Conditions of Entry.
18. No responsibility accepted for late, lost or misdirected entries.
19. The Promoter is not responsible for any technical malfunctions or problem on internet congestion, including injury or damage to an entrant’s or any other person’s computer related to participation in this Promotion and any problems with transmission of entries over the internet.
20. The Promoter is not liable for any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained during the course of accepting or using the prize, except for any liability which cannot be excluded by law.
21. Entries are deemed to be received at the time of receipt into the Promoter's database. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission. The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer network, or lines, servers, or telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to participants or any other person's handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this promotion.
