eBay has special rules limiting who can sell travel-related items on eBay, and what can be sold. Sellers who want to list travel-related items must adhere to all rules outlined in the Examples section below.
Violations of this policy may result in a range of actions, including:
Listing cancellation
Limits on account privileges
Account suspension
Forfeit of eBay fees on cancelled listings
Loss of PowerSeller status
Providers of Travel: A business that actually provides the travel service, such as airlines, trains, coach companies, cruise operators, hotels or resorts may list items such as their own gift certificates, packages or services. However, when listing an item the travel provider should clearly identify themselves as the actual providers of the service being offered.
Travel agents, and other businesses selling travel services: Businesses and individuals, who sell, advertise or arrange travel services (but do not directly provide the travel service themselves) may list travel services on eBay provided that they are licenced to provide such services in Australia. The listing will clearly indicate their licence number as well as any other affiliation such as AFTA membership. They may not, however list any travel service prohibited by eBay as set out below. Sellers are required to include the following disclaimer in all listings for travel exactly as it appears below and in a text size and color that can easily be seen and read by all bidders:
"By listing this auction I verify that I am the actual travel agent or travel provider and not a third party affiliate. The travel/accommodations in this auction will be booked directly through me and not an outside agency. I also verify that, other than the government taxes and related government fees stated within the listing description itself, there will be absolutely no additional fees, charges or after auction purchases associated with booking the travel within this listing."
Individuals: The Travel Agents Act of 1986 (NSW) prohibits a person from carrying on business as a travel agent unless licenced. However, in most jurisdictions persons are exempt from travel agent licencing if the total value of travel arrangements made does not exceed $30,000.00 in any one financial year. Accordingly individual travelers or small operators such as sporting or social clubs can list on eBay, but may not list more then one trip per month. In this instance the seller can play no role other than delivering the listed item.
Travel club memberships and "choice travel" certificates: eBay will not permit listings of travel club memberships or "choice travel certificates" or similar items by any user. Travel club memberships include any service, cards, or identification number that purports to give the holder the right to free or discounted travel, that is, certificates that entitle the holder to some travel related benefit (such as free or low cost hotel stays) with a variety of travel providers.
Please note that many airline tickets, vouchers, and frequent flier miles are not transferable, and sellers should review any travel related item before listing to make sure that it can be transferred legally to another party and will be accepted by the issuing provider of travel services.
Travel club memberships and "choice travel" certificates: eBay will not permit listings of travel club memberships or "choice travel" certificates or items of a similar nature. Travel Club memberships include any service, cards or identification number that purports to give the holder the free right or discounted travel, that is, certificates that entitle the holder to some travel related benefit such as free or low cost hotel stays. Choice Travel certificates are documents that are not issued directly by a single provider of travel, but by travel wholesalers, consolidators, or other middleman travel sellers. These certificates generally offer the holder free or low cost travel services with a choice of multiple hotel chains, resorts or airlines, with the exact location often being at the choice of the buyer or seller. In many cases the use of these services require additional purchases and are in violation of eBay's fee circumvention policy, as such these items may not be listed on eBay by any user.
Safe Travel
While it is the responsibility of the individual traveller to prepare adequately for overseas travel, eBay requires sellers to clearly advise in their listings any relevant travel advisory issued by the Australian Department of Foreign Affairs and Trade, which promotes the safe travel of Australians over seas. This information can be located on the DFAT website.
Why does eBay have this policy?
eBay urges its sellers and buyers to comply with all governmental laws and regulations. Since the sale of travel related items is highly regulated, or may cause harm to eBay or its members, sellers are restricted in their listing of them on eBay.
