Medical devices and equipment policy

Medical devices that require a prescription can't be sold on eBay. Medical equipment that could be abused for unlawful means is also not permitted. Listings for items that are permitted must follow the guidance below.

This policy was updated on 12 April 2024 to include information about medical equipment that could be abused for unlawful means, and is effective as of that date.

It's important to check that items can be sold on eBay before they are listed.

What is the policy?

The following aren't allowed:

The following medical equipment and related products, which can be abused for unlawful purposes, are not permitted:

  • Items or device parts which could be used to facilitate the manufacture of illegal drugs or pharmaceutical products
  • Needles, with or without a disposable syringe

Listings for items that are allowed must meet the following requirements:

  • Listings must state in the item description if the device has been opened or used:
    • Used items must be properly cleaned
    • Used items must not be altered in any way that changes the performance or safety specifications of the device
  • The item description should clearly state the product expiry date
    • Items must reach the buyer before the expiry date
  • Some medical devices can only be sold with government authorisation. Listings for these items must be listed in the Industrial > Healthcare, Lab & Dental category
  • The sale of COVID-19 home-use tests that are available without a prescription is restricted to pre-approved sellers*, who must:
    • Only sell tests that are approved by the TGA - opens in new window or tab
    • Ensure their listing description complies with TGA advertising restrictions - opens in new window or tab and includes the ARTG number
    • Only list in the Health & Beauty > Health Care > Monitoring & Testing > Other Monitoring & Testing > Covid-19 Self Tests category
    • Only offer domestic postage
    • Only use a fixed price format (not auction or Best Offer) and price the item in accordance with applicable law(s)

The following items can be sold:

  • Over-the-counter (OTC) medical devices
  • Vintage or collectable medical devices, but listings must state that these are not intended for use
  • New disposable syringes can be listed, but needles cannot be included
  • CPAP/BiPAP/VPAP accessories

Activity on eBay is required to follow this policy, the eBay User Agreement and all applicable laws, as well as respect the rights of third parties. If it doesn't, eBay may take action consistent with applicable laws and the eBay User Agreement, and may even be legally required to do so. Such actions may include, as an example only: Removing the listing or other content, issuing a warning, restricting activity or account suspension.
