Hazardous Materials

Hazardous goods may pose a danger to health, safety or property while being transported. Examples include explosives, radioactive materials, flammable gases and solids, and toxic substances. Many hazardous goods cannot be posted through the mail or commercial carriers. Such items are not allowed to be listed on eBay.

A few hazardous materials may lawfully be transported under certain conditions if they are properly packaged and labelled. Such items may be listed on eBay, provided the listing contains a clear notice of the hazardous nature of the material, and a description of the planned method of postage that complies with the law. Violations of this policy may result in a range of actions, including:

  • Listing cancellation

  • Limits on account privileges

  • Account suspension

  • Forfeit of eBay fees on cancelled listings

  • Loss of PowerSeller status

Some Examples

Examples of hazardous materials not permitted on eBay:

  • Carbon tetrachloride: Antique fire extinguishers that contain carbon tetrachloride, including glass bulb fire extinguishers and brass extinguishers with a "T" shaped handle.

  • Tritium: Exit signs, glow sticks or similar, self-luminous devices that contain tritium.

  • Radium: Any military instrument containing radium.

  • Fireworks: Fireworks or pyrotechnic devices are heavily regulated or banned in Australia under the Dangerous Goods Act 1975 (NSW). All fireworks contain explosive substances and are therefore classified as Dangerous Goods.

  • Batteries: Federal law regulates the sale of batteries containing mercury. As a result, eBay does not allow the sale of these types of batteries.

  • Radioactive waste and ‘contaminated’ items: Any item described as ‘contaminated’ by radiation is not permitted on eBay. For example, a rock taken from the Maralinga nuclear test site. Some everyday items may contain trace amounts of radioactive materials or types of radioactive materials such as watches, clocks and other timekeeping or navigational devices, unrefined ores, and smoke detectors. These items have been specifically approved for distribution.

  • Freon and other refrigerants: State and Territory Governments regulate the sale of refrigerants, including chlorofluorocarbons (CFCs), Hydrochlorofluorocarbons (HCFCs) and products commonly known as Freon. Most of these products may not be lawfully sold in Australia or even used to maintain existing equipment and subsequently may not be listed on eBay. For more information on laws relating to the sale of refrigerants, see the Ozone Protection Act of 1989 (NSW).

  • Nuclear items: The US Nuclear Regulatory Commission (NRC) and various states regulate the possession and use of radioactive materials. Subject to some exemptions, these regulations limit the sale or transfer of radioactive materials to people licensed to possess such materials and items that contain such materials. If you trade in radioactive materials or items containing radioactive materials, you should contact the NRC to determine if these materials or items are subject to regulation and whether they can be bought or sold by unlicensed persons, such as members of the general public.

Postal Service restricted items

Some items restricted by Australia Post generally do not pose a danger to health, safety or property while being transported, but their transport is regulated or banned for public policy reasons. Many of these restricted items such as alcohol, firearms, pets, drug paraphernalia, and lock picking devices are not permitted on eBay under other eBay rules.

Generally, restricted items that may be lawfully transported by mail or courier are permitted on eBay, unless prohibited by other eBay rules.

Perishable items

Perishables are items that can deteriorate or lose value under normal mailing conditions. Perishable items include eggs, meat, poultry, game, fish, fruit, vegetables and certain liquids, pastes, powders and tablets. If you're dealing in perishables, educate yourself about the postal regulations and follow the rule.! Why does eBay have this policy?

eBay urges members to comply with all governmental laws and regulations. Since the sale of hazardous materials are prohibited by law, regulated, or may cause harm, sellers cannot list them on eBay.
