Describing Drugs or Drug-like Substances

eBay prohibits sellers from describing legal substances, such as plants or herbs, in a manner that suggests ingesting, inhaling, extracting or otherwise using any substance or compound from the legal substance that will provide the same effect as an illegal drug, compound or substance or that will provide unsubstantiated health benefits.

eBay looks to the Therapeutic Goods Administration and other regulatory agencies for guidance on items that violate their policies on inappropriate marketing.

Violations of this policy may result in a range of actions, including:

  • Listing cancellation

  • Limits on account privileges

  • Account suspension

  • Forfeit of eBay fees on cancelled listings

  • Loss of PowerSeller status

Some Examples

  • Listing an herbal product and marketing it as a substitute for marijuana

  • Listing muscle-building supplements and claiming that they have the same effect as steroids

  • Listing an herbal product and claiming that it will produce the same results as Viagra

  • Listing medication with the claim that it has the same effect as OxyContin

  • Listing a substance as a miracle cure or which makes unsubstantiated health claims

Why does eBay have this policy?

eBay urges its sellers and buyers to comply with all governmental laws and regulations. Since certain unsubstantiated promotional and marketing claims related to drugs and drug-like substances are prohibited by law and sales of these items may cause harm to eBay or its members, sellers may not market items with such claims on eBay.
